These are the General Terms and Conditions of Charlie & Jones, a B.V. established according to the legislation of the Netherlands. Charlie & Jones is located at Herengracht 141 in Amsterdam in the Netherlands. Purchases on the webshop
You can place an order with Charlie & Jones by clicking on all the desired items on the website, which will place the products in your 'shopping bag'. You can check your items in the 'shopping bag' and make the necessary changes. Once the shopping bag matches your wishes, you can click on the checkout button. This then generates an electronic order form stating the desired items. After completing the order form including the payment details, you can click on. Continue and you will be redirected to a secure environment to complete the financial transaction. This will complete your order. After processing your order, Charlie & Jones will in principle send an e-mail to confirm receipt. If a product is not in stock, you will be contacted as soon as possible and the amount will be refunded. The purchase agreement is completed in this email. The agreement will therefore be deemed to have been concluded in the Netherlands. Charlie & Jones reserves the right to process any transaction for any reason and/or refuse service to anyone at any time in its sole discretion.

Prices and information about the website
The prices on the website include VAT. The total price stated on the order and on the electronic order form includes the price including shipping costs. Any and all customs or import duties and/or local taxes will be borne by the customer. The above costs are not included in the price. Prices are subject to change at any time. Changes in prices do not affect the sum payable in a concluded purchase agreement as confirmed by Charlie & Jones by email. Although all information relating to prices, specifications etc. is placed on the website with the utmost care, Charlie & Jones makes no warranty as to its accuracy. Charlie & Jones is not bound to issue any orders placed based on incorrect information displayed on the website. Certain links on the website provide access to websites and information resources operated and maintained by third parties. Charlie & Jones has no control over these sites and accepts no liability for their contents.
Payment
Payment can be made by credit card, Paypal or Ideal. By using a particular credit card (number) you confirm that the credit card being used is yours. The amount due will be debited from your account when your order has been accepted by Charlie & Jones. All credit card holders are subject to checks and validation authorization from the credit card company. If the issuer of your payment card refuses to authorize a payment to Charlie & Jone, we will delay delivery and contact you. In that case, Charlie & Jones not liable for any delay or non-delivery. Credit card details are processed using an SSL (secure socket layer) connection. Charlie & Jones is not liable for any misuse of this data by third parties.
Delivery
Charlie & Jones will do its utmost to deliver all purchases within five working days. Charlie & Jones is not liable if delivery takes place at a later time. Charlie & Jones has the right to deliver the order up to thirty days after the order without being declared in default by the customer. If the term is exceeded, the customer will receive written confirmation. The customer can then terminate the agreement free of charge. The customer will then receive the paid amount back as soon as possible, but no later than thirty days after termination.
Deliveries are made by PostNL courier. If the courier fails to deliver your order on the first attempt, he/she will leave a message informing you when the second attempt will be made. This process is repeated one more time, after which PostNL will contact you to discuss your wishes regarding delivery (send to another address, back to the sender). All items are insured by Charlie & Jones until delivered to your address. Any complaints about the condition in which the goods were delivered (including missing parts) must be made to Charlie & Jones no later than two working days after receipt of the goods by email or telephone at the address / number in page 1.
What is the right of withdrawal?
The right of withdrawal applies to our non-personalized products as described in the Consumer Rights Directive. You then have the right to let us know within 14 days of receipt that you wish to exercise your right of withdrawal. It is best to contact our customer service for this.
After this notification, you still have 14 days to return the product. In that case, the return costs will be borne by the customer. The full purchase amount, including any (standard) shipping costs for the outward shipment, will be refunded by Charlie & Jones as soon as possible and within 14 days after termination of the agreement.
Personalized products are excluded from the right of withdrawal (as described in our additional terms and conditions. You may be charged if you have damaged the package)

Liability
Liability to the buyer is limited to the amount of the purchase price. Charlie & Jones will never be liable for any loss of profit or goodwill or any other consequential loss. We are not liable except in the case of intent or gross error. Furthermore, we are not liable for any direct or indirect damage (such as consequential damage, lost profits, lost savings or damage due to business stagnation) for which we have not expressly determined our liability in these conditions. Our liability will in all cases be limited to the amount of the price agreed for that order (excl. VAT). Charlie & Jones is not liable for any damage, illness, disease or injury to the dog, nor for breaking a collar clasp for any reason whatsoever. We always advise our customers to carefully check whether closures work due to: the possibility that a dog has bitten a shackle; and or all other possible causes of damage to a collar. If you have a fighting dog, a dog weighing more than 10 kilos, or an aggressive dog, you must decide for yourself whether the collar is suitable. For large, strong dogs, we recommend using the collar only as an accessory and using another collar for leashing. The customer is responsible for assessing the correct collar and leash.
Governing Law and Forum
The laws of the Netherlands apply. Any dispute relating to a purchase and sale agreement to which these conditions apply will be submitted exclusively to the District Court of Amsterdam, unless Charlie & Jones chooses to bring this dispute before the competent court of the buyers' place of residence.

Purchases in the webshop

After completing the order form (including payment details) click “Continue” and you will be directed to a secure environment to complete the financial transaction. Your order is then complete. After processing your order, Charlie & Jones (in principal) sends an e-mail to confirm receipt of your order. If a product is not in stock, we will contact you as soon as possible and refund the amount of the product. The purchase agreement is entered into with the email. The agreement is therefore deemed to have been concluded in The Netherlands.Charlie & Jones reserves the right to refuse to process a transaction and/or refuse service to anyone, at any time and at its sole discretion.

Payment

The amount payable will be debited from your account when Charlie & Jones accepts your order. All credit card holders are subject to validation checks and authorization by the card issuer. If the card issuer of your payment refuses to authorize the payment to Charlie & Jones, we will postpone delivery and we will contact you. In that case Charlie & Jones is not liable for any delay or non-delivery. Credit card details are processed through a SSL (Secure Socket Layer) connection. Charlie & Jones is not liable for any use or abuse of the data by third parties.
Delivery
Charlie & Jones will do its utmost to deliver all purchases within three business days. Charlie & Jones is not liable if the delivery takes place at a later date. Charlie & Jones has the right to deliver up to thirty days after the order has been placed without consequences. Should the thirty-day limit be exceeded then the customer will receive written confirmation. The customer may cancel the order/contract at no charge. The customer will receive a refund as soon as possible, but no later than thirty days after the contract was terminated. Deliveries are made via POSTNL/DHL/UPS couriers. If the courier is unable to deliver your order on the first attempt he/she will leave a message, specifying information about when you can expect the second delivery attempt to be made. This process is repeated once before POSTNL/DHL/UPS contacts you to discuss your requirements in regards to delivery (e.g. send to another address, return to sender). Charlie & Jones insures all items until the moment they are delivered to your address. Any complaints about the condition of the goods upon delivery (including missing parts) must be made to Charlie & Jones by email, phone or in person at the address above no later than two business days after receipt of the goods.
Returns?
All goods sold by Charlie & Jones (except personalized articles) can be returned within fourteen business days after delivery. Cancellation automatically leads to the termination of the purchase agreement between Charlie & Jones and the customer and hereby the customer is required to return the goods to Charlie & Jones within seven business days of receipt of the goods. Returned goods which are returned after the specified period can be returned to the buyer without refund. All correctly returned products will be credited within 30 days either as a refund to the credit card of the original purchaser or to the bank account, excluding shipping costs. The shipment costs of return shall be borne by the buyer. To be entitled to a refund, the product must be returned in new, unused and unworn condition with the labels still attached and in the original packaging. New and unused means that it has no stains on the item and no wear or tear on the labels. Any free items that were sent by Charlie & Jones should also be returned.
